So called "Fresh annual"

I've got a broker telling me a plane he is selling comes with a fresh annual. Come to find out, it had its annual 6 months ago, and to him "fresh annual" means they will sign it off when it is sold.

Is this even legal? It certainly isn't a fresh annual if it was done 6 months ago and I have to question an AP/IA who would even do this kind of work, and not sign it off.
